Terms and payment terms

These terms govern your use of Top Billing, operated by Top Billing. By placing a bid you agree to them.
1. What we sell
Top Billing sells advertising placement on a public board for a fixed display period. The highest bidder for a period gets Position 1 — a full-width billboard carrying their brand colour, logo, tagline and link. Lower paid positions get a listing with logo and link.
You are buying placement, not a result. We do not guarantee any level of traffic, clicks, conversions or revenue.
2. How the auction works
- Each round sells one display period. Bidding opens when the previous round’s bidding closes and shuts a fixed period before the display begins.
- Positions are ranked by amount, highest first. Where two bids are equal, the one placed earlier ranks higher.
- Winners pay the amount they bid, not the amount of the next bid down.
- If a bid arrives in the final minutes, bidding is extended briefly so others can respond. There is a cap on how far a round can be extended.
Bids are binding
A bid cannot be withdrawn, lowered or cancelled once placed. An auction only functions if bids are commitments. Please be certain of your amount before confirming it.
3. Payment terms
- All amounts are in Indian rupees. The amount you bid is the amount you pay — no tax is added. We are not registered for GST and therefore do not charge it.
- Placing a bid authorises the amount with your bank. It is a hold, not a charge.
- You are charged only if you win. The charge is made when bidding closes and the result is settled.
- If you do not win, the authorisation is released and no money is taken. See cancellation and refunds.
- Raising your bid authorises only the difference, not the whole new amount again.
- An invoice is issued for every winning bid and emailed to you.
Payments are processed by Razorpay. We do not receive or store your card details.
4. Your creative
You are responsible for everything you supply — brand name, tagline, logo, imagery and destination link — and you confirm that:
- you own it or are licensed to use it;
- it is lawful, truthful and not misleading, and complies with the ASCI Code and applicable Indian advertising law;
- it does not infringe anyone’s trade mark, copyright or other rights;
- the destination link is a working page that matches what you are advertising.
Every creative is reviewed against our creative guidelines before it is shown. We may decline anything that does not meet them. If we do, your placement is held and you may submit replacement artwork — you do not lose the position you won.
Paid placements are labelled as advertising, as required by advertising-disclosure rules.
5. What we may refuse
We may decline a bid, refuse a creative or suspend a brand where the advertising is unlawful, deceptive, or promotes categories we do not accept. If we refuse a bid before it is charged, no money changes hands.
6. Availability
We aim to keep the board available continuously but do not guarantee uninterrupted service. If a technical failure on our side means your placement was not shown for a material part of the period you paid for, we refund proportionately — that is set out in the refunds policy.
7. Liability
To the extent permitted by law, our total liability to you for any claim connected with a placement is limited to the amount you paid for that placement.
We are not liable for indirect or consequential loss, including lost profit, lost business or loss of goodwill.
Nothing here limits liability that cannot lawfully be limited, including for fraud.
8. Changes to these terms
We may update these terms. The version in force when you place a bid is the version that governs that bid. Material changes are announced on this page with a new date.
9. Governing law
These terms are governed by the laws of India. The courts at India have exclusive jurisdiction over any dispute.
